Acceptable Use and Fair Use Policy

Subject to compliance with this Policy and our Terms of Service, you may use the Service to generate assets for personal, commercial, and client projects, including but not limited to product design, marketing materials, games, and digital media. Generated Content may be used commercially without additional licensing fees.

You may not use the Service to generate or process:

• (a)Content that violates any applicable law or regulation;
• (b)Content depicting real, identifiable individuals in compromising, defamatory, or fabricated situations without their explicit consent;
• (c)Content that constitutes hate speech, harassment, or threats against individuals or groups;
• (d)Content intended to spread disinformation or manipulate public opinion;
• (e)Content that is sexually explicit, pornographic, or involves minors in any sexual context;
• (f)Content that could cause physical harm, financial harm, or facilitate criminal activity;
• (g)Content that infringes the intellectual property rights of third parties.

All generation requests are screened by automated moderation systems designed to detect prohibited content. We may also conduct manual reviews where automated systems are inconclusive. Screened content is processed in accordance with our Privacy Policy.

Violations of this Policy may result in, at our sole discretion:

• (a)Removal of prohibited Generated Content;
• (b)A warning to the account holder;
• (c)Temporary suspension of access to the Service;
• (d)Permanent termination of the account, with forfeiture of unused credits;
• (e)Referral to appropriate legal authorities where the content violates law.

If you believe your account or content was affected in error, you may appeal by contacting legal@xeycompany.com with details of your case. We will review appeals within fourteen (14) business days.
